LinkedVAnow Terms of Service

CASTANET Inc, doing business as LinkedVAnow ("LinkedVAnow," "we," or "us"), operates LinkedVAnow.com and the LinkedVAnow service.

The following terms and conditions govern all use of the LinkedVAnow.com website and all content, services and products available at or through the website, including the LinkedVAnow managed service and related software (taken together, the "Services"). The Services are subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies, and procedures published from time to time on this Site by LinkedVAnow (collectively, the "Agreement"). Our Privacy Policy at https://www.linkedvanow.com/privacy is incorporated by reference.

Please read this Agreement carefully before accessing or using the Services. By accessing or using any part of the website or Services, you agree to become bound by this Agreement. If you do not agree to all of the terms, you may not access or use the Services. The Services are available only to individuals who are at least 18 years old and to businesses acting through an authorized adult.

Your LinkedVAnow Account.

If you create an account on the Services, you are responsible for maintaining the security of your account and for all activity under it. You must immediately notify LinkedVAnow of any unauthorized use or other breach of security. LinkedVAnow will not be liable for any acts or omissions by you, including any damages incurred as a result of such acts or omissions. You must provide accurate account and billing information and keep it current. You must not, in the use of the Services, violate any laws in your jurisdiction or in the United States (including copyright or trademark laws).

Cancellation Policy

You may cancel LinkedVAnow services with 30-day written notice, which, depending on timing, may include one additional month of support.

Notice of cancellation must be submitted in writing and sent via email to your designated Account Manager or support contact.

We do not sell personal information to third parties. We do not buy, sell, rent, exchange, or share business leads, consumer lists, mobile numbers, or SMS opt-in data. We do not share your personal information with unaffiliated companies so that they can market their own products or services to you.

We share information only with service providers that process it on our behalf to operate the Services (for example, payment processing, hosting, customer support, analytics, and the vendor that transmits account SMS if you have opted in). Those providers may use the information only to perform services for LinkedVAnow and must protect it consistent with our Privacy Policy.

When appropriate or required we may disclose information, including personal information, to protect our legal rights, in response to a court order, or in connection with a sale or merger of LinkedVAnow or its assets. LinkedVAnow will endeavor to make such disclosures subject to protective orders or confidentiality agreements.

Text messaging originator opt-in data and consent are excluded from every sharing category in this Agreement. That information will not be shared with any third party other than the messaging vendor that transmits the messages.

Receipt of Communications.

If you no longer wish to receive promotional communications from us, email your Account Manager or support@linkedvanow.com. You may still receive account, billing, and legal notices. If you have opted in to SMS, reply STOP to cancel texts.

Server Security.

LinkedVAnow takes reasonable and appropriate steps to protect personal information, including limiting access to personnel who need it to operate the Services, working to detect unauthorized access, and not retaining information longer than needed for the purposes described in our Privacy Policy.

Third Party Sites.

The Website may link to third-party websites. Those sites have their own privacy policies and terms. LinkedVAnow is not responsible for how a third party collects or uses your information.

Payment and Renewal.

By signing up for a LinkedVAnow account you agree to pay the fees presented to you when you purchase the service. Fees are invoiced starting from the day your paid account is established and in advance of the service period. LinkedVAnow reserves the right to change fees upon thirty (30) days prior written notice. Paid accounts renew for successive periods of the same length until canceled with 30 days written notice as described above. Fees already paid are not refundable except where required by law.

Support.

LinkedVAnow includes access to email support. "Email support" means the ability to make requests for assistance by email (with reasonable efforts by LinkedVAnow to respond within three business days). Support is provided in accordance with LinkedVAnow's standard practices.

LinkedVAnow Platform

Any use of the Platform is bound by this Agreement plus the following specific terms:

SMS Notifications

CASTANET Inc dba LinkedVAnow sends SMS only to paying LinkedVAnow customers who separately opt in to account notices. If you provide a mobile number and opt in, we use that number only to send first-party service and account messages about your LinkedVAnow subscription (onboarding, scheduled calls with your account manager, reports, portal activity, billing, and support).

We do not text a client's prospects, customers, leads, or any other third party. Prospecting for our clients is performed only through LinkedIn's messaging system. We do not buy, sell, rent, or share SMS opt-in data. Consent is collected and used only by CASTANET Inc.

Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help. Consent to receive SMS is not required as a condition of purchasing or using LinkedVAnow services. Carriers are not liable for delayed or undelivered messages.

All other sharing descriptions in this Agreement exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties other than the vendor that transmits the messages.

Damage and liability.

No one has been banned for using LinkedVAnow, but we wouldn't be responsible in case this happens. Don't mix our service with automation tools.
LinkedVAnow is not affiliated with LinkedIn in any way.
It is your sole responsibility to comply with LinkedIn rules and any legislation that you are subject to. You use LinkedVAnow at your own risk.
We are not responsible for your actions and their consequences. We are not to blame in the unlikely case of your accounts getting banned for any reason.
We require access to the LinkedIn account you designate so we can deliver the Services. We don't give away, or otherwise distribute your information to any third parties except as described in this Agreement and the Privacy Policy.
We can't guarantee any specific outcome from using LinkedVAnow.
We can't guarantee the continuous, uninterrupted or error-free operation of the service.
We reserve the right to modify, suspend or withdraw the whole or any part of our service or any of its content at any time without notice and without incurring any liability.
You expressly understand and agree that LinkedVAnow shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible losses (even if LinkedVAnow has been advised of the possibility of such damages), resulting from your use of the Platform.

Discontinuation.

LinkedVAnow reserves the right at any time to modify or discontinue, temporarily or permanently, your access to the Platform (or any part thereof) with or without notice.

Marketing.

As a user, you give LinkedVAnow a perpetual world-wide license to use your company's assets and logos, unless LinkedVAnow agrees in writing otherwise. These assets and logos will be used purely for marketing and sales efforts, such as being displayed on the homepage.

Copyright Infringement.

If you believe that material located on or linked to by LinkedVAnow violates your copyright, notify us at support@linkedvanow.com. LinkedVAnow will respond to notices as required or appropriate, including by removing the material. LinkedVAnow may terminate access for a repeat infringer. In that case LinkedVAnow will have no obligation to refund amounts previously paid. You agree that upon purchasing our service you understand what you are purchasing and will not file a fraudulent dispute.

Intellectual Property.

This Agreement does not transfer from LinkedVAnow to you any LinkedVAnow or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with LinkedVAnow. LinkedVAnow, the LinkedVAnow logo, and all other trademarks, service marks, graphics and logos used in connection with LinkedVAnow or the Services are trademarks or registered trademarks of CASTANET Inc or its licensors. Other marks used in connection with the Services may be the trademarks of third parties. Your use of the Services grants you no right or license to reproduce or otherwise use any LinkedVAnow or third-party trademarks.

Use License.

You may not attempt to decompile or reverse engineer any software contained on LinkedVAnow's website or Platform, or access the Site or Services in order to build a similar or competitive service. This license shall automatically terminate if you violate any of these restrictions and may be terminated by LinkedVAnow at any time.

Changes.

LinkedVAnow reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes. New features or services will also be subject to this Agreement.

Termination.

LinkedVAnow may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. If you have a paid account, you may terminate this Agreement by giving 30 days written notice as described in the Cancellation Policy. LinkedVAnow may terminate a paid account immediately if you materially breach this Agreement and fail to cure within thirty (30) days after notice, or immediately as part of a general shut down of the service. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties.

The Services are provided "as is". LinkedVAnow and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither LinkedVAnow nor its suppliers or licensors makes any warranty that the Services will be error free or that access will be continuous or uninterrupted. You use the Services at your own discretion and risk.

Limitation of Liability.

In no event will LinkedVAnow, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) interruption of use or loss or corruption of data; or (iv) any amounts that exceed the fees paid by you to LinkedVAnow under this agreement during the twelve (12) month period prior to the cause of action. LinkedVAnow shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

General Representation and Warranty.

You represent and warrant that (i) your use of the Services will be in strict accordance with the LinkedVAnow Privacy Policy, this Agreement, and all applicable laws and regulations, and (ii) your use of the Services will not infringe or misappropriate the intellectual property rights of any third party.

Indemnification.

You agree to indemnify and hold harmless LinkedVAnow, its contractors, its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Services, including your violation of this Agreement.

Miscellaneous.

This Agreement constitutes the entire agreement between LinkedVAnow and you concerning the subject matter hereof, and may only be modified by a written amendment signed by an authorized executive of LinkedVAnow, or by LinkedVAnow posting a revised version. Except to the extent applicable law provides otherwise, this Agreement and any access to or use of the Services will be governed by the laws of the State of California, excluding its conflict of law provisions, and the proper venue for disputes will be the state or federal courts located in San Luis Obispo County, California. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys' fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition or any breach, in any one instance, will not waive such term or condition or any subsequent breach. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms; LinkedVAnow may assign its rights without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
